Creditor Rights: Post-Judgment Collection
A creditor's judgment is of no value unless it can be collected. Fox, O’Neill & Shannon, S.C.'s creditor's rights attorneys know how to effectively navigate the often confusing and otherwise time-consuming task of judgment collection. From registering a judgment, through execution, supplementary examination, garnishment, lien enforcement and mortgage foreclosure sales, FOS will do all it can to ensure that its creditor clients obtain full recovery from their debtors.
The multiple post-judgment collection steps include ensuring that a judgment is registered in all areas, including non-Wisconsin states, where a debtor has real property, having the sheriff execute on a judgment, questioning a judgment debtor under oath as to the debtor's collectible assets, garnishing a debtor's wages or other assets, scheduling, posting notices of, attending and obtaining confirmation of foreclosure sales, obtaining replevin of personal property, and performing similar activities to enforce personal property liens.
The creditor's rights attorneys will also investigate a debtor's asset activities to prevent or obtain repayment of fraudulent asset transfers.
When appropriate, FOS's creditor's rights attorneys will arrange for a receivership of the debtor's assets.
